ENVIRONMENTAL LAW PRACTICE

SAHN WARD & BAKER provides a broad range of services for its clients in the area of environmental law.  The Firm’s practice includes environmental related litigation both to prosecute claims of environmental damage and to defend clients from such claims.  The Firm also counsels clients in matters relating to the environmental investigation and remediation of specific sites, and negotiation of compliance agreements with regulatory agencies.  We also provide clients advice as to compliance with requirements relating to the preparation and submission of environmental impact statements for specific projects pursuant to the New York State Environmental Quality Review Act (SEQRA) as well as the requirements of federal laws, and represent clients in environmental due diligence.

Our environmental law practice often inter-relates with the Firm’s litigation, real estate and land use practice areas so that we provide our clients with counsel and advise in all aspects of the law.

The following are typical of the types of cases the Firm handles in the environmental law area:

Representation of a client in litigation to require an adjoining property owner to remediate contamination on our client’s property and for the recovery of damages as a result of such contamination.

Representation of a client in a proceeding to vacate and annul a municipality’s findings of no significant environmental impact in the re-zoning of the client’s property from commercial to residential use.

Representation of clients in completion of environmental due diligence in the acquisition of parcels of real property.

Representation of various clients in the preparation, submission and review of environmental impact statements for proposed actions, such as the subdivision and development of land.

Counseling the Firm’s municipal clients on their obligations under relevant environmental laws and regulations.
